A little legal levity for a Friday afternoon. Enjoy!

Advice from lawyers

George and Lenny decide to cross

North America in a hot-air balloon. However, neither was a particularly experienced balloonist, and Lenny’s mind quickly drifted from navigation to thoughts of how clouds look like cuddly little bunny rabbits. Upon realizing that they were lost, George declared, “Lenny, we are going to have to lose some altitude so we can figure out where we are.”

George lets some hot air out of the balloon, which slowly descended below the clouds, but he still couldn’t tell where they were. Far below, they could see a man on the ground. George lowered the balloon to ask the man their location.

When they were low enough, George called down to the man, “Hey, can you tell us where we are?” The man on the ground yelled back, “You’re in a balloon, about 100 feet up in the air.”

George called down to the man, “You must be a lawyer.” “Gee, George,” Lenny replied, “How can you tell?” George answered, “Because the advice he gave us is 100 percent accurate and is completely useless”.

The man called back up to the balloon, “You must be a client.” George yelled back, “Why do you say that?” “Well,” the man replied, “you don’t know where you are or where you are going. You got into your predicament through a lack of planning and could have avoided it by asking for help before you acted. You expect me to provide an instant remedy. The fact is, you are in the exact same position you were in before we met, but now it is somehow my fault.”

Welcome to the launch of Making it Legal – The Small Business Mentor’s Guide to Entrepreneurship and Law! I’m Nina Kaufman, a small business attorney, occasional stand-up comic, and your guide through the wild, wooly, and wonderful of having a strong legal foundation for your business growth and success.

I know that many women entrepreneurs look forward to receiving legal information about as much as having root canal surgery without anesthetic. No surprise. It’s dull, written in a completely foreign language (might as well be Aramaic), and conceptually thorny. To make matters worse, it’s often delivered with a dry, haughty, “how-can-you-be-so-ignorant-that-you-don’t-know-this� tone. I say, phooey! to all that! My goals for Making it Legal are to:

  • Help empower women entrepreneurs to become comfortable with legal issues and advisors
  • Demystify the mumbo-jumbo that often surrounds legal concepts
  • Share examples of others’ successes and missteps that you can learn from
  • Translate the jargon/lingo into plain English
  • Serve as an information resource to help you know more

And . . .

  • Have fun doing it!

It’s that last point that’s especially important. Yes, entrepreneurship is about learning. It’s about making money. It’s about pursuing a dream. And not every day will be a “gold star� day, that’s for sure. But if you’re not having fun, the days become drudgery. I’ll work to make small business legal issues less scary, less mind-boggling . . . and hopefully bring a smile to your face in the process. In turn, Making it Legal is part of a conversation about how to make your business the best it can be, and I welcome hearing from you. I’m looking forward to building a community with you of empowered women entrepreneurs who enjoy laughing as they learn – even if some of the lessons are hard ones.
